It's not. The decision to grant is being appealed to the supreme court.

but have they been grant leave to appeal or are they just saying it is there intention to appeal

They must get someone from the Supreme Court to hear the case and then grant further stay if necessary. However, there was no one from the Court available to hear it today, and so it will be heard when such time as someone next becomes available.

This is confusing but afaik, the original ruling on Monday granted a stay to appeal to SC until today at 4pm. Earlier today the club representatives tried to convince the RC to drop the case due to new business plan, revenue stream etc etc. RC said no but 4pm deadline still applies.

However SC finishes or has finished sitting for 10 weeks so there's either a scramble to get an appeal in before 4pm or Justice Lafoy has granted a stay until Wednesday for this appeal to be submitted or the SC will sit to hear the appeal on Wednesday or...

Will Cork just do themselve a favour and just pull the bloody plug and start rebuilding a new club from tomorrow morning. This is getting silly!!

Someone else suggested that because the Supreme Court close for August, we may get a default stay until September on it.

We're legally entitled to have the appeal heard anyway, so it's a case of when they can facilitate it.

No in 5 years time the club will be stronger if the right decision is taken now. If you do come through this you'll be left with all sorts of millstones around the neck. (no prize money, no sponcership due to the fact that the club got advances, massive debts) This will all just catch up on you again.

Yes. And if I remember correctly, Monday's judgment said you had to appeal by 4pm today. Now if the legal team didn't do that before now, I think the courts' stance is "tough s**t".

I, as well as many City fans, agree. We'll probably be allowed to keep the name and we'll probably be owned by the fans. That's win-win in the long-run!

Not sure about that. Our entire squad are free agents; half of them have already left. Our wage bill has been slashed massively.

if you were to win your appeal all the aforementioned players would still be contracted and can seek payment in full. making them free agents does not mean there contracts have dissapeared

Looks like they're back before the judge shortly and the order could be confirmed then or it may be stayed until Wednesday, apparently it's very unlikely that it would be stayed for any longer and techncially she may not even be able to stay it until Wednesday. All the efforts could be just too late. That's according to the Cork forum again.

I hope they can be saved Coughlan can be ousted and the club can be solvent and put on a sustainable path. Sadly that's probably just wishful thinking. :(

Would FORAS not try and get one or two backers behind them and offer to buy the club and let the fans run it toghether with one or two bigger backers?That way nobody can be blammed but the fans themselves?

It wont be fair on other clubs like cobh if they get a deal when they cant pay. Cobh never got a deal accepted did they? So why should cork get off again again and again. Coughlan has done this to the revenue. If they cant get the money to pay it off then its just going to get worse in the long term. He's just slowing the process down.

But if they are saved surely the FAI will have to set in and punish them in some way! Thats not on, nearly going into liquidation one week and then battling for a European spot another!

Would you and the rest above who are moaning that City might have sorted this just give it a rest.

City haven't entered examinership (i know they can't twice), haven't broken any league rules so why would they be punished?

This is a matter of outstanding tax and if the tax is paid in full then nothing wrong has been done regardless of when. It's the Revenue Vs. Cork City. Extensions and stays are irrelevant as long as the Revenue are happy.

By the way, people go to court all the time due to arrears, including tax. You go to court to settle it and if all the tax is paid, it's settled.
