I think it's worth having a thread to record the fabulous adventures of our very own PFAI and their very own hot shot lawyer Staurt Gilhooly. They provide their fair share of WTF moments so well worth keeping them together I think.

Hard to know whether this is LOI or EPL....

If LOI, there is one club rumoured to be struggling (or just not bothered) with wages. Question is, how many of their players would be PFAI members?

Have now read full Suarez judgment. Overall, it's an utterly embarrassing decision based on logic that would make Monty Python cringe....

Strangely his unbiased opinion always comes down on the side of Liverpool.

Not the first time he's done that either. Couldn't comment on the Zayed/Turner incident but happy to back Suarez against Evra.

I feel sorry for Suarez having guff merchants like Gilhooly trying to back him up

Maybe its because Ross was not wholly innocent. Whilst the alleged comments made to him were disgusting, his decision to celebrate in front of away fans instead of his own, and his particular choice of hand gesture was not a smart move on his behalf. He only invited the referee, who no doubt didn't see/hear the preceeding off the field antics during the game because he was focussing on the game.

All that you say may well be correct.

But this is very dangerous territory, where it appears that the taunting of these "Fans" (as you call them) ultimately lead to their team getting an advantage on the pitch. The fact that Gaynor got red carded will only encourage more of the same from other "fans".

Any half rational Players body would be standing up against the abuse of the players - racist abuse not ok, other types fine and dandy?

Very simple solution...anyone chanting something like that should and should have been ejected by security. Therefore having no effect on the game and there is no incentive to do it.

Was Delighted to get this tweet(along with others on the same subject) last night(slow Twitter night),Allan has been a fan of the LOI for years.Glad i read it right too BTW.Might have gotten confused and thought i was gone completly bananas what with all the drugs & stuff i've had over the weekend only for the prompt at the end of the tweet reminded me that it was Allan Johnson who won :confused: :rolleyes:

Statements from the PFAI and Mr Gary Dunphy following the decision of the FAI DRC - Mr Gary Dunphy v Waterford United Football Club

From the PFAI:

We represent Mr Gary Dunphy who has been employed as a player by Waterford United for 5 years up until the conclusion on the 2012 season. He began to experience significant difficulties in his hip area over the course of 2012 season and in June of last year, his hip gave way resulting in a referral by the club doctor to Mr Patrick Carton in the Whitfield Clinic, who is an acknowledged expert in this area. Mr Carton immediately recommended arthroscopic surgery to both hips in order to provide Gary with his only chance to return to playing football. This was communicated to Waterford United and they were asked to promptly arrange for such treatment and be responsible for the fees in accordance with their obligations under Clauses 16 and 19 of the Standard Players Contract. They failed to do this and indeed have not provided any funding towards the players treatment. He was provided with injective therapy through the public health system which has not been successful and Mr Carton has recently stated his disappointment that the surgery was not provided when first suggested as he feels he could be back playing by now, had the surgery been carried out when first advised.

The PFAI attempted to communicate with Waterford United up until late last year but it became clear that they did not intend to uphold their obligations and in fact refused to engage with the issue in any meaningful way. As his contract was not renewed at the end of the 2012 season, the player was forced to use the FAI's dispute resolution process to reach a satisfactory conclusion. This has resulted in a ruling that Waterford United will have to be responsible for the cost of the player's operations.

It is deeply regrettable that it was necessary to enter such a lengthy and costly process. It has been clear from the outset that the club were obliged to pay for treatment and their refusal to do so is hugely disappointing. We are aware that the vast majority of clubs are conscious of and compliant with their obligations in respect of medical treatment and we hope that such a dispute does not arise again in the future. However, clubs should be aware that the PFAI will continue to support its players in such circumstances and will vindicate their rights should it be necessary.

From Mr Gary Dunphy:

I'm very relieved that this saga is finally over. I'd been committed to Waterford United for over five years and had given my all for the club. As most people are aware, wages in the League of Ireland, and particularly the first division, are very low but I was delighted to play for my hometown club, no matter what the pay. It was a real surprise and massive disappointment to me that they failed to do anything to assist me when I got injured and I felt like I was hung out to dry because I was no use to them anymore. I've haven't heard a thing from the club since last September. Now, I'm looking forward to getting the operations done as soon as possible and getting back to playing football which is all I've ever wanted to do. I'd like to express my appreciation for assistance of the PFAI, particularly Ollie Cahill, Stephen McGuinness and their solicitor, Stuart Gilhooly.

They seem to be right for a change here, albeit we have heard nothing from the other side of the story.

That's the point though, a good union is very much needed in the LOI.

They're not a union though.

I believe the solicitor wasn't present for the hearing, they used someone else instead

As Mr A stated, so far there is only one side to the story. If what is being presented is even close to being factual, it would reflect badly on those involved on behalf of the club.

I hope Waterford make a statement to clarify this as a matter of urgency

Waterford United would like to express its disappointment with the tone and nature of the statements from the PFAI and Gary Dunphy.

The club believes that it has, at all times, discharged its duty of care to Gary in respect of his injury and it was through Waterford United that Gary underwent treatment at the National Centre of Excellence at Cappagh Hospital. The medical opinion from those experts in Cappagh suggested a treatment plan other than immediate surgery.

Notwithstanding the decision of the DRC, Waterford United has, through its medical officer, sought to ensure that Gary received the proper care which is still supposed to be ongoing. Gary Dunphy has stopped this treatment at his own volition.

The club communicated its inability to fund a private treatment costing between €10,000 and €15,000 to Gary and expedited his attendance at the National Centre for Excellence at Cappagh. In keeping with the conditions of the Standard Players Contract, this treatment was arranged as quickly as possible.

The PFAI’s solution was to try to force the club to re-sign the player even though he was injured, which would have restricted the manager’s choice of playing staff for the current season and the Board felt this was unreasonable.

Waterford United is now considering its position in relation to the DRC decision and is evaluating its options going forward.

And there's more, this time from the PFAI:


The PFAI has been made aware of a statement released by Waterford United yesterday which purports to provide details of the clubs treatment of its former player, Gary Dunphy. While the majority of the statement is inaccurate and misleading, we do not wish to engage in a lengthy debate about this issue, so we propose to merely correct a glaring untruth which is causing Gary further distress.

Waterford United claim in the statement that Gary Dunphy stopped treatment "at his own volition". This is blatantly untrue. As we have previously outlined, Mr Patrick Carton, the acknowledged expert for injuries of the kind suffered by Gary advised last July that he required an operation. Because the refusal and failure of the club to arrange and pay for such an operation, he arranged for conservative injective treatment to be carried out in Cappagh under Mr Pat O'Neill. When this was unsuccessful, Mr O'Neill specifically advised him that such procedures would not give him any further benefit and it was Mr O'Neill who advised against further treatment. Waterford United and its doctor are, or should be, fully aware of this and to suggest otherwise is disingenuous and grossly unfair to a player who the club have already treated with cavalier disregard.

It should be noted that the independent FAI panel that heard the case reached the following conclusion: "The DRC is satisfied that the claimant requires surgery in both hips to enable him to resume his playing career based on reports from Mr Patrick Carton and this surgery should have taken place following the claimants consultation with Mr Carton in July 2012. The DRC is also satisfied that the Club did not arrange the appropriate treatment."

Gary will shortly undergo the first operation (both hips require surgery separately) and Waterford United will have to abide by the DRC ruling and pay for the surgery.

Whatever about the rest- the bit saying that most of what WUFC said was wrong is annoying. Either contradict them or don't mention it, this broad implication without detail is just arsey.

I think their SIPTU affiliation provides them with the protection of Trade Union legal status re negotiating license and the exemptions from prosecution re actions in contemplation or furtherance of a trade dispute.
It drags SIPTU`s reputation into the gutter to be associated with this " management company".

Haha, hopefully Mr Gilhooly tweets his apology too. Club proved right by their care of Dunphy and insurance company duly paid up. I dont see us welcoming his back anytime soon :D

I think it was the lambasting tone of their statement that annoyed most people, basically saying that Waterford United had done wrong by their treatment.
The club, and all the specialists/medical team that were involved, maintained that they did what they should have done. The insurance company have agreed that they did what they should have, and are now covering the cost.

Wouldn't blame PFAI for it tho, their care is to the player and not the clubs. Player is getting sorted which is main thing but don't see him back playing LOI/

Stupid error, alright, and one that could cost them, but RTE has a noble tradition of getting club's names and venues wrong and misidentifying players on MNS and Aertel, so I'm not sure I'd hold them in the same good light that he does. Unless he's adding a zero to the libel claim as he types....

Sure how can you have a management company trip without a solicitor? It would be madness, Ted, madness.

Robinson was signed for Haka by Sami Ristila, who he played with at Drogheda. Robinson then recommended McFaul to them.

I thought it was strange that he was going over to cover such a mickey mouse event when it can be hard to get journos to cover European games sometimes.

To be fair, the only way to get journos to cover it is to pay their expenses. The FIFPro tournament might be interesting but not so interesting that a newspaper is going to spend a grand flying their man out there. PR companies drag journalists all over the world to ensure coverage. Tourist boards rely on it.
