I think Charlie has this one right. As long as shams are paying Kenny they can avail of his services as much or as little as they wish. To pursue a constructive dismnissal case he would have to walk away from his contract. Also far from uncommon for EPL teams to be paying managers (and occasssionally players) long after they have left
Most likely possibility is that Kenny wants to seek another job and therefore wants to terminate his contractual relationship with shams (by reaching agreed settlement). Shams are playing handball by not agreeing a severance package (by continuing to pay him as per contract) thereby hoping to push him into a more reasonable settlement.
This is of course speculation as without knowing the terms of his contract it is impossible to be sure. Wioll be very interesting (but unlikely) if neither side blind and details role out in court.
