    EL Pre-Contract Players

    Whilst the Ciaran Martyn fiasco has the whole of Tolka in a tizzy and most of Derry (myself included) delighted it still has an air of mystery about it.
    What is a Pre-Contract, what purpose does it serve? I don't know of any other EL situations that involve the Pre-Contract controversy, have there been any recently or ever?

    Interesting......or not as the case may be!

    I thought that Martyn had agreed to move to Shels verbally then changed his mind. First I heard of a pre-contract. There's a lot of talk of Cisse having a pre-contract to move to Liverpool so I presume it's something along de lines of a statement that de player favours moving to your club above others but nothing is as yet binding??

    More of a statement of intent I'd guess.

    Ya whats it all about?
    Miller has signed one with with united,but if he had a long term injury between now and the end of the season could manure change their minds and tell celtic they don't want the player.If its not a binding contract I mean.

    i think its when a player has a certain amount of months left on his contract, say 6 which would point to a June/July expiry that other clubs can come in and offer him a contract without going to the club about a fee, unless hes yopung and its compensation. The first that springs to my mind is steve mcmanaman going to real madrid.

    Not sure though.

    I don't think Man U or Miller can stop that move happening now. I think that is binding, but it's probably different to what Martyn did. Martyn was out of contract already when he talked to Shels wasn't he?

    Naw. Martyn signed the pre-contract agreement his season, when Keely was in charge. His last contract ended on 31st December, so he was still contracted to City when he signed the pre-contract agreement.

    I'm not so ignorant as to not know about English Transfers and European bores....Miller, McManaman, Cisse *YAWN*

    I was actually wondering has it ever happened in the EL before. Sorry for being ignorant but it was turning into a 'look at what happened in the Premiership - Admire that like!'

    A pre-contract is binding. It means that the club agrees to offer a player a contract, with the terms already set, after his current contract expires. The player, for his part, agrees to sign it. It can't be backed out of.

    EU rules say that you can only offer one six months before the player's contract expiry, though prior to those rules comming into force, Bayern Munich signed pre-conracts with Sebastian Deisler and Michael Ballach, giving them huge signing-on fees to garuantee that they'd move to Bayern when their contracts were up.

    Martyn signed a new contract with Derry, so he didn't have a pre-contract with Shels.

    Cisse can't sign a pre contract with Liverpool because his current contract with Auxerre isn't up until 2006. Millers contract on the other hand is up in the summer so the 6 months rule is invoked automatically. A pre contract can only be signed in this 6 month period, unless the players club allows otherwise. Never seen it in the EL before though.

    Sheesh You also posted "What is a Pre-Contract, what purpose does it serve?"

    I guess de answer to your (second) question is that there has not been any other precontract eL situations 'cos best we can come up with is premiership examples (to answer your 1st question )

    For the eL, or in general?

    It's an EU rule, part of the exception they granted to football to let the transfer system continue. Late 2000, I think.
