Detective Garda Declan O'Carroll said that Mr Halvey Halvey was arrested at the scene of the fatal crash and that subsequent breath tests showed there was an alcohol concentration of 83 micrograms of alcohol per 100 millilitres of breath. The legal limit at the time was 35 micrograms.

I thought the legal limit was 80?

Not condoning his actions but there is big difference between 2.5 times the limit & fractionally over the limit.

Not much the government or any one can do if judges hand out sentences like that.

I didn't realize the IRFU did the sentencing...

Inconsistent application of sentencing. There was a similar case in Donegal last week and the driver got a (substantial?) custodial sentence even though he was in a wheelchair.

I'm all for the independence of the judiciary but inconsistent decisions like this argue for minimum sentences and stronger guidelines.

At the end of the day he got into his car after consuming alcohol and ploughed into the back of a car killing a boy. Whether the alcohol was consumed before he got into the car or a couple of hours before has no real relevance as such, considering a reasonable person would not take the risk. The fact is he took the risk and the ultimate price was paid...a young boys life. Therefore this should be reflected in the sentence which it wasn't which in my opinion was an utter disrespect to the young mans life.

it stinks if you ask me,anybody who knows Halvey or has ever came across him will tell you how much of an ar$e he is,he should of got a long sentence,its a total disgrace
i heard Mick Galway was a character witness for him,if this is true he has gone way down in my opinion

I wouldn't worry about precedent. As I said above, on 8th May in Donegal a drunk driver who killed five people was jailed for 4 years, despite a guilty plea, being confined to a wheelchair and substantial remorse.

I still think that's light btw.

Halvey's case is nothing other than a judge who didn't follow guidelines.

Michael McDowell was an odious man but had the right idea about sentencing guidelines.

feel very sorry for the family but to be fair eddie halvey is not a criminal so why send him to jail? im sure not a day goes by where it doesnt go through his head that he killed someone.

id rather see criminals behind bars than someone who did something very stupid

sorry i should have qualified that, he has been convicted of a road traffic offence not a criminal offence

A criminal is a person who commits this wrongful act.

His girfriend at the time was with him in the jeep and she begged him to pull over and stop driving. He refused she asked to get out he let her off at the side of the road. Then 20 mins later he ploughed into the back of them. If you seen the picture of the car after you would cry. It was horrific.-

i dont see him as a criminal, to me a criminal is a drug dealer, a thief etc, and yes i am fully aware he killed someone and its a tragedy but it was an accident in my opinion. im not condoning drink driving for a moment, i just dont see what good sending him to prison would do.

For my money, if a sober, qualified driver makes an error or is simply overwhelmed by some unexpected circumstance, the outcome is an accident. If a man chooses to drink and drive, he's responsible for the outcome.

I would agree with that. Its a bit like other trials where someone tries to use alcohol & drugs as an excuse.

I believe he got a 7 month suspended sentence. He should be made go live with the people who lost a son for the 7 months. Those poor people got a life sentence and that drunken ******* walks. Its nothing personal against Halvey but by god my blood boils. I read a case in the paper today where a guy got 3 months in jail for stealing 2 sausage rolls in Tesco. Fact.
