if you ever read the phoenix 'that guy' in the article, they have someting about him and court cases in the last few issues of it

According to Bray Wanderers' current owners, the High Court injunction was taken in order to prevent financial and reputational damage to the club.
If this wasn't so tragic, you'd have to laugh.
"three individuals from representing themselves in an official capacity on behalf of the club."
I would imagine that the wording of this is not just aimed at the Deering "takeover" but also something to do with the "hacking"? of the club website story that was doing the rounds last week. The "EGM?" was advertised briefly on the club website and then promptly taken down and replaced with a post saying " that rumours of an EGM are false"
Actually, the clue (which I missed earlier, as well) was in the word "Removal". That could only take place at an EGM called for that purpose, according to Section 149 of the Companies Act 2014 - and the supposed EGM, which didn't specify such a purpose, wasn't in any case due to take place until two days later than the filing.
Guns being jumped all over the place, it seems.
S146, not S149. As you say, the directors "resigned" before the EGM. And in any event, the EGM notice wasn't long enough to call for a removal of directors anyway, so it couldn't have dealt with the matter.
So if Deering has simply gone and signed a form saying they resigned, and appointing himself as director, he could be in quite a bit of trouble. It'd be no different to me going down the CRO now with a form appointing myself as director and removing him.
The Indo has a bit more detail on this this morning
So adding two and two (and maybe coming up with five), it seems Deering appointed himself and removed the other four as directors (as per the B10, which he shouldn't have signed), and then presumably used this form (or the CRO records - same thing) to say he was taking over the club on match day.Quote:
Last Saturday, counsel said, the game between Bray and Derry City was put in jeopardy when Mr Deering arrived at the ground with a group of others, including Mr Lennon and Mr Quigley, and with two gardai.
Mr Deering represented himself as a director and said he was taking charge of the club's affairs with immediate effect. He claimed that four directors had been removed from the Bray Wanderers company.
Following conversations involving the gardai, the League of Ireland and the FAI, Mr Deering and the others agreed to leave. The game against Derry proceeded.
However counsel said Mr Deering has also given a number of interviews to media to say that he would be taking charge from Monday July 13. Counsel said Mr Deering is not a director nor has he any authority to take charge.
Bray Wanderers Ltd chairman Denis O'Connor said in an affidavit that Mr Deering, of Kilgobbin Road Stepaside, Dublin, is a former director and a small shareholder in the company (with 2.26 per cent)
Mr O'Connor said previously Mr Deering, who said he represented a Northern Irish Company, approached the club concerning a proposed development of offices, retail units and a football stadium.
The proposal was not deemed feasible by the company, Mr O'Connor said. He said Mr Deering continued to communicate with him in a manner he described as "bordering on harassment."
Did a bit of searching on this Deering fella and came up - rather surprisingly - with a post on here, which doesn't really reflect well on him.
The problem with the whole process of what is going on is nobody will come out and truthfully say these are our plans for the club / ground etc. If the best interests of the club are at the heart of things just come out and say it.
There is a lot of information out there in the public domain and some conspiracy theories. It is time to put it all to bed and lay the cards out on the table.
None of the sides involved in what is going on are doing themselves any favours (apart from one group who were involved at the start of the season but seem to have taken a step back and not got involved in any of the recent messiness) - I'm not including anyone trying to get monies owed in any of the above....
I am seriously worried there is some truth to the rumours that the club is being deliberately run into the ground for the sake of a property deal. Even if it's not, the most likely explanation is the club is being deliberately run badly in order to massage some gombeen's ego, which is almost as bad.
Hi Guys,
So it's just been announced that Gerry Mulvey owns 80% of Bray wanderers now.
What insight can you give us into his time at Pats?
Cheers,
Tip.
According to Dodge on Twitter, he tried to move Pats out of Richmond and over to Tallaght. For me that's very interesting considering all the rumours regarding Bray moving elsewhere!
Got involved when Pats were in the ****s financially. Left with Pats still in the ****s financially.
In between he helped put out a few fires and talked of selling Richmond and moving to Tallaght.
His statement said he left Pats when they were top of the league but they had finished 7th in the 2006 season. Kelleher came on board in that off season (through meeting the Pats chairman, not Mulvey).
RTÉ reporting a new investor announced
Former Pat's guy. Don't know if the Pat's fans know anything about him?
Edit - already covered here. Mods, feel free to merge I guess.
Bad news for Bray this all but confirms its a land grab. They will out of the Carlise & in a new ground on the edge of town within five years.
Or sharing with Shams. Their ground is already in Wicklow.
I'd say it will be within two years. Site already been earmarked according to reports. Bray has 14 years left on the lease to the Carlisle Grounds so would have to be paid off to leave early.
If they actually came out and said this was the case and showed the plans maybe it would be better for Bray with a proper stadium and all weather training pitch which seems to be proposed.
This individual was heavily involved with Pats when we were set to move to SDCC stadium as co tenants with Rovers until Mr K saved the day its no coincidence that the same person gets involved with Bray at this current time.
This isn't the high court its a football fans forum imo this individual isn't getting involved with bray for football.
Threads merged. Hard to keep up with this story!
Oh Bray just when I start to get depressed about on field results I remember things could be worse

They just posted this on Facebook:

The club website is out of action due to 3rd party interference. We currently don't have access to the club site so therefore it can't be updated. We hope to have it fully functional again next week
Key to this thread is to make sure the post contains 'allegedly' at the end!
Hate to say I told you so. Assumed hacking all along, although hacking is probably a strong word for what's going on, rather, the wrong people have the password to the site and blocked the people in charge from gaining entry.
It's fantastic, cringeworthy, and bloody ridiculous at the same time.
We should start issuing a new type of asterix on the league table for most entertaining f*ck up of the season.
The club has been run badly for years. Money wasted time and again but the people looking for action now didn't want action then. I wonder why!
Explain...
I worked for the club in the past under the old regime and i'm the one who posted this so i shall presume you are aiming this at me. What are you trying to imply?

On another note, Wanderers are back in court this morning. A lot of dirty laundry being aired, some of it obviously quite worrying as a Wanderers fan...
My sentiments exactly ! hence why i'm looking for support.
I certainly didn't know how bad thing were, maybe other people did though... but from my perspective i brought a lot of advertising revenue into the club at that time and was doing a lot of community work that seemed to be having a small impact on crowds

Talk about Wanderers at 13.50 minutes in
"Supporters fighting a loss cause" article in today's Times.
Owners of Bray Wanderers pursue club’s recovery against run of play..............
Also in the Irish Times during the week - "Bray Wanderers legal action finds resolution"
All of that to me implies that the three (or specifically Deering, being the only one who was a director) did misrepresent or impersonate directors, claim to act in an official capacity, etc.Quote:
When the matter returned before the court yesterday, the judge was told, following discussions between the parties, the injunction proceedings were not going ahead as the three defendants were prepared to give a number of undertakings.
The three agreed not to trespass on the grounds without prior arrangement, although they may attend football matches and other public events without prior engagement and authorisation.
They also agreed not to publish any information purporting to be official information from the club company.
They further agreed not to misrepresent or impersonate directors of the company, claim to act in an official capacity or call official meetings of the club.
Mr Deering also agreed to delete all data in his possession obtained through accessing the company’s email account server and website system.
And later in the article -
So basically Deering did pretend he was a director to appoint himself as a director, resign the other guys and take over the club himself.Quote:
As part of the company’s claim, it had been alleged Mr Deering filed official papers with the Companies Registration Office which purported to record the removal of four directors of Bray Wanderers Ltd and the appointment of Mr Deering as director.
Counsel said his client wants to have those filings annulled, and the status quo restored.
It was claimed Mr Deering represented himself as a director and said he was taking charge of the club’s affairs and had purported to organise official meetings of the club.
Deering sounds like a complete nut.
