Without a presence in either the United States or Armenia, they have two hopes: No and Bob.
The only option is to go to an arbitrator, and that'll cost 'em a thousand bucks or so, plus the solicitor.
Sorry, but it has to be said: Serves 'em right.
adam
Well, they have only have one Bucks!Quote:

I agree, they deserve to be stung like that for being so cheap and ignorant of the situation in the first place.

a couple of interesting cases from the WIPO site include Gusinness and The F.A.
It looks to me like the cowboys have got themselves in a bit of a fix...
Adam, correct me if I'm wrong but...
Do the Board now have to come up with a lot of money for lawyers etc. just to get back the domain name - a domain name they won't even be using! They'll have to do something, now that it was on RTÉ news!
Are they the biggest shower of idiots that ever walked the planet or what?
yea theres a few more good ones in there as well.
joe maybe you could provide advice to the club....seeing as you'd prob know more then anyone at the club put together in this matter..
not for one second that i'm saying your an expert on internet pornography or anything...
oh no..never..i'd never even hint at something like that :D

They don't have to do anything. They have four options:
1) They could just ignore it completely and let the publicity fade out. When the summer rolls around and the domain name expires again - it's unlikely yerman will renew it - they could try and pull it back, but it's not guaranteed. Those of us with a bit of knowledge in this field know how to do this - I pulled beecher.net out of the roots recently - but so do the cybersquatters.
2) They could take the legal route, which will achieve nothing, because, as I already said, the cybersquatter is in Armenia, with a corporation in the United States (this is the same ******* who pulled limerick-diocese.org out of the roots). This would be throwing money - lots of money - down the drain. This is the route their solicitor will advise.
3) They can go to an arbitrator. When you sign up for a domain name, you have to agree to something called the UDRP. This basically states that when you register the domain name, you agree to use an ICANN-approved arbitrator to decide on disputes. What happens is that they file a complaint with an arbitrator, the arbitrator sets up a panel to review the information, the panel contacts the registered user and asks them to respond, and after a short time, they file a response. City is almost guaranteed to win in this case, because the Armenian guy won't respond (he's a serial cybersquatter). Aside from trying to sue though, it's the most expensive option, because the arbitrator will charge about $1000 to handle it, and they'll need a solicitor to file the complain too.
4) They can pay the cybersquatter the fee. I wouldn't trust this guy as far as I could throw him though, so I would advise City to get an ascrow agent to handle the transaction. This is basically someone who sits in the middle and takes control of the transaction - the seller gives the product to the escrow agent, the buyer gives the money to the agent, and the agent performs the transaction. This would cost a minimum of $600.
If it was me, I'd go for 1), followed by 3)... and that would be it. I wouldn't give the cybersquatter the soot of it, and I wouldn't be stupid enough to try and take it to court. I've advised City of their options and that I would be willing to discuss the matter with their solicitor. Free of charge I might add.
It should also be noted that every item of coverage on this matter I've seen so far has been inaccurate in varying degrees. For a start, if the Limerick Diocese went to WIPO, they would have paid a minimum of $1000 to get the domain name back, and not £30 as stated in the piece. Also, the "site" is not backed by a US company, as stated in the Football365 article, it ultimately leads back to Armenia.
adam
and no way in hell would option 1 work cause City would never be fast enough to get there ahead of any fans thats wanted the domain ;)
They're looking for $550.00 at least.
"corkcityfc.info" is available though.

interesting breakthrough from citynet messageboard
"Its wasn't in City's possesion; it was in the possession of someone they let use the 'official' title. that person seems to have sold the domain or linked this porn himself to make money.
And its funny that the media only realise this a year after the sites gone.
Nice to see someone at RTE reads the Echo though.

Actually rebel, if you look through foot.ie carefully, you'll see me (quite generously IMHO) offering corkcityfc.net on a "free transfer", even though they had (and still have) absolutely no right to the domain name. I would have gladly have handed over corkcityfc.org too, and I would have been quite happy to register corkcityfc.biz and corkcityfc.info on their behalf...
Unfortunately...
adam
Heh, dahamsta offers up doms on bosmans, eh? Creepy. :)
adam
ah but sure we're only an amateur club!it doesn't really matter! FOOLS!
Hands up anyone who think city will choose the wisest option?
BTW i'd like to disassociate myself with the "new" rebel. It not me...
