Dungannon Swifts to take Derry City to Court

Dungannon Swifts are preparing to take Derry City to the High Court over money they claim they are owed relating to the transfer of Niall McGinn to Celtic.

Swifts chairman Jarlath Faloon says the Candystripes had agreed to pay his club an agreed share of the cash from any future transfer involving the player.

It is "supposed" to be Linfield. But it's been established that we don't owe them any money.

I wish to **** the board would get off their arses and just pay their dues.

Derry really have treated Dungannon despicably in this, fair play to Swifts for standing their ground.

I would doubt that. I'm sure the overdraft could be extended to cover it. It's not like we got a lot from Celtic - hence the board not making the fee public.

If it's proved that Derry have owed this money all along we have another example of the sham that is licensing.

A, the transfer hadn't technically happened during the licensing process and therefore no money(transfer fee, sell on or otherwise) was due at that point.

However as you say, fair play to Dungannon, they deserve what they are due. Pity we couldn't have got their board in to do the deal with Celtic, I reckon we'd have come off far better:mad:

Definitely. Why didn't the board bring Dungannon into the figuring when the deal was done. We definitely could have just got Celtic to pay it direct to them, without Derry having to put their hands on Dungannon's share at all. It's so ****ing daft that we have ourselves in this situation.

Is it 20% we owe? Think how much Tam must be getting in wages, and we only brought him in a few weeks ago (not making him a scapegoat at all, but if the board wants to bring in new players they have to settle their debts first). The money must have been available before.

I really think that the money can be made available. Our finances are seemingly decent enough, so surely �40,000 can be stumped up from somewhere?

Derry have done something like this before. Thy signed Wayne Russell from KCFC years ago and we were due payment in installments IIRC. Wayne got ijured straight away and we never got another cent. I'm sure it's not just Derry though, do Sligo still feel they are owed money from Drogheda?

I think in this league you should keep trasfers simple. And prolonged payment scheme or installment/add-on fees will just lead to trouble when the buying club eventually has to pay and doesn't have the cash to give.

For what it is worth I was speaking to a representative of Dungannon a couple of months ago, around the time when the High Court writ was first issued, and he suggested that Derry were in severe financial turmoil and this was one of the main reasons for their failure to pay up.

From a slightly less reliable source I had heard that Derry were trying their best to keep the exact details of the transfer fee quiet as they sought to pay Dungannon less than they were actually entitled to.

As has been obvious on this thread, I'm in no way defending Derry.

However Philly your facts on this one are wrong. Russell was signed on loan, with an option for us to sign him permanently at the end of the season. No transfer fee was due. As you say, very unfortunate for Russell but Derry were in the clear.

Last I heard we are a creditor of Drogheda. They still owe us about 30K from the Faz transfer.

Not any more you're not. All creditors would have been written off when they came out of examinership, bar the 2p in the � or whatever offer they made.

Did I read somewhere that Dungannon issued a writ firstly to "Derry City FC" and it was then withdrawn as Derry trade under a different name?

Possibly. I think we trade under Wellvan Enterprises or something similar. I'm not 100% certain mind.
