If Linfield didn't offer a contract as stated in the article, they haven't a leg to stand on. As for verbal contracts.......

Our legal advisor has a fairly good record in recent years (after Saddam anyway) :D

We will have to see. I'm no expert so I will just let it run it's course.

The one key thing that I would point out is, Derry City offered a 'goodwill' gesture of 3k. Which to me gives the impression that DC might be in the wrong here.

90k for Stewart would be very nice though :D

Linfield will get no more than what we paid for any other player in the same situation, if we have to pay.

If Linfield have not offered Thomas Stewart a contract in writing via registered post at least 60 days before the expiry of his current contract there will be no training compensation. As for £45,000 per year, Jim Kerr has been wrongly advised, in the category of club he is dealing with. Also, Thomas Stewart has have had to be signed as a professional by Derry ;) what's to say he has? I'm also sure that training compensation will only be paid up until Stewarts time with Linfield up until his 21st birthday. The 23 rule is to protect players up to that age.

Article 6 Special provisions for the EU/EEA
1. For players moving from one association to another inside the territory
of the EU/EEA, the amount of training compensation payable shall be
established based on the following:
a) If the player moves from a lower to a higher category club, the
calculation shall be based on the average training costs of the
two clubs;
b) If the player moves from a higher to a lower category, the
calculation shall be based on the training costs of the lowercategory
club.
2. Inside the EU/EEA, the fi nal season of training may occur before the
season of the player’s 21st birthday if it is established that the player
completed his training before that time.
3. If the former club does not offer the player a contract, no training
compensation is payable unless the former club can justify that it is
entitled to such compensation. The former club must offer the player
a contract in writing via registered post at least 60 days before the
expiry of his current contract. Such an offer shall furthermore be at
least of an equivalent value to the current contract. This provision is
without prejudice to the right to training compensation of the player’s
previous club(s).

Luckily, both clubs are from the same Civil juristriction.

I'm not saying we do, but if you think guidelines are concrete, you are fooling yourself.

I don't think we will get 90k, but I do think we will get something. I cannot see Linfield persuing something that would make them look foolish can you?

I also don't get why DC would offer 3k 'goodwill' gesture either if they didn't have something to be wary of.

So maybe it is not as black and white as you may think.

Maybe a good will gesture is to do exactly as it says on the can - maintain 'good will' between two clubs who will undoubtedly have dealings between each other again in the future ?

Maybe the relatively small sum of £3k was offered because City knows that it is in the right, but would rather save the time, legal costs and bitterness involved in this going further - and is conscious also of the need to work with Linfield again in future ?

You're right - things aren't always black and white :)

It looks like the ball is in Derry's court unless the player is inclined to back up Linfield to the hilt, that there was an agreeable verbal contract.

Will the offer of £3k goodwill be withdrawn should Linfield persist with their training fee demand?:D

I would say that this is generally argued in cases in which a player has been with the one team for a considerably longer term than Stewart had been with Linfield.

Businesses do not give away money for no reason. I do not believe in Goodwill gestures by football clubs.

I do find it rather ironic and amusing some one from stroke city having a jibe at Belfast. But there ya go.

Whys that? Lets be honest here Belfast is full of self-centred big headed arseholes. Derry has its fair share but Belfast is full of them

fair enough but surely you realised during that time that not everyone in Belfast was the same! Belfast Derry City SC? I take it that it was mostly made up of Derry student wans living in the Holylands!
